A4WD Assumption of Risk, Release / Waiver of Liability, Indemnity Agreement and PR Release

In consideration of being permitted to participate in any event held by, promoted, offered, sponsored, or directed by Adventure 4WD, Inc. (formerly Let’s Go Jeepin) as a Driver, Mechanic, Owner, Attendant, Participant, Spectator, Bystander, Child, Spouse, Relative, or in any other capacity, the undersigned, hereby releases Adventure 4WD, Inc., it’s Directors, Officers, Employees, Volunteers, Sponsors, Promoters and Agents, of all liability to the undersigned for himself/herself, his/her next of kin, his/her heirs, and his/her personal representatives, regardless of if there is a negligent act or omission of release information by Adventure 4WD, Inc., it’s Directors, Officers, Employees, Volunteers, Sponsors, Promoters and Agents to the undersigned.

In addition, the undersigned agrees to indemnify and hold harmless Adventure 4WD, Inc., it’s Directors, Officers, Employees, Volunteers, Sponsors, Promoters and Agents, from any claims, actions, demands, actions and causes of action whatsoever arising out of or relating to any loss or damage to the undersigned or the undersigned’s personal property including vehicles, or injury including paralysis or death, regardless of if there is a negligent act or omission of release information by Adventure 4WD, Inc., it’s Directors, Officers, Employees, Volunteers, Sponsors, Promoters and Agents to the undersigned.

Furthermore, the undersigned is voluntarily participating in said event knowing their present conditions and acknowledging the potential for hazardous or dangerous conditions to arise, and agrees to assume full responsibility and risk for any loss or damage to the undersigned or the undersigned’s personal property including vehicles, or injury including paralysis or death while the undersigned is participating in the event, on the property the event is held, traveling to/from the event, or conducting any transactions related to the event, regardless of if there is a negligent act or omission of release information by Adventure 4WD, Inc., it’s Directors, Officers, Employees, Volunteers, Sponsors, Promoters and Agents to the undersigned.

This release shall be legally binding upon the next of kin, heirs, personal representatives, distributees, executors, administrators, power of attorneys, health care representatives, and guardians of the undersigned.

In signing this release, each of the undersigned hereby acknowledges and represents:

that he/she is over eighteen (18) years of age and is of sound mind;

that he/she has read the foregoing release, understands it, and signs it voluntarily;

that he/she will wear their seat belts at all times while in the vehicle;

that he/she will not consume any alcoholic beverages or mind-altering substances which may impair his/her judgment in relation to this event;

that he/she will not posses any dangerous or controlled substances including, but not limited to firearms/explosives;

that he/she has a current and valid drivers license, current and valid vehicle registration, inspection, and license plates, and the minimum limits, whatever they may be for the undersigned’s state of residency, of vehicle liability insurance;

that all passengers/occupants of the vehicle will be registered for the event and the undersigned is fully responsible for his/her passengers/occupants and understands that no results are guaranteed in any manner by A4WD;

that the vehicle has been inspected by the owner/driver and has been certified by the owner/driver to be in good and safe mechanical condition;

that the vehicle has a working four wheel drive system and has frame mounted (not welded) front and rear tow hooks that are appropriately rated for the vehicle’s weight for recovery purposes;

that the owner/driver, all passengers/occupants, and others participating in this event in any capacity will abide by the rules, guidance, and instruction of Adventure 4WD, Inc., it’s Directors, Officers, Employees, Volunteers, Sponsors, Promoters and Agents and accepts full responsibility for not abiding by the rules, guidance, and instruction which may involve expulsion from the event without refund;

that Adventure 4WD, Inc., it’s Directors, Officers, Employees, Volunteers, Sponsors, Promoters and Agents reserve the right to limit the number of participants in each event and the right to refuse service without being liable for any loss or damages that may arise from the refusal to provide service;

that in the event of any dispute, contract or tort, the laws of the State of Indiana shall apply without exception.

In signing this release, each of the undersigned further hereby acknowledges and represents that Adventure 4WD, Inc. and those whom it is acting for, or those acting on behalf of: Have to right to copyright and use, reuse or publish photographic images, advertising copy, written and overheard testimonials, portraits, names and any video or audio matter of me or likeness of me in conjunction with my own or fictitious name in every manner for the purpose of promotion/advertisement in every media past, present, or future without further compensation.

This is a release which waives valuable rights which you may have. Read it thoroughly before signing it. By signing below, you acknowledge you understand it and agree to be bound by its terms and conditions, including waiving the legal rights you may have.

For a participant under 18 years of age, the minor’s legal guardian must sign this release form on behalf of the minor and write the minor’s name, age, and the word "minor", next to the legal guardian’s name and signature.
